Spring is here! That means two important Easter and Passover are quickly approaching. For many, these holidays include religious services, family gatherings, and special meals. These upcoming occasions also remind me that I have not addressed the issue of faith-based directives in estate planning in this blog.
When it comes to burials, religious observances, or specific bequests, a person’s faith can play a prominent role in making estate planning directives. And in my role as an estate planning attorney, it is my responsibility to see that my clients’ wishes are respected by establishing them in a legally valid estate plan.
If a person is observant throughout his or her life, it seems natural that they would want the customs of his or her religion will be followed upon their death. However, there are other considerations too. With so many blended and non-traditional families around these days, what if a person’s family does not share the same religious beliefs? What if the deceased has bequeathed assets to a faith-based charity or institution that the rest of the family does not support? Addressing questions such as these make faith based estate planning all the more essential.
