Estate Planning: How Do You Choose The Right Trustee?

If you decide to include a trust as part of your estate planning, you will need to name someone as Trustee.  And we aren’t necessarily talking about your best friend, your neighbor the lawyer, or even your closest relative. Your choice for trustee should be someone you know to be a reasonable, prudent person who will fulfill the duties and obligations involved in carrying out your wishes as specified by the trust, and ensure that the funds involved are distributed properly.  In legal-ese, we call that “trust administration”. The selection of your trustee should be made very carefully.  It can be quite a risk to you, your heirs, and your estate to choose someone who is less than fully committed to following rules.  Your trust administrator has the legal responsibility to carry out all your instructions, as well as satisfying all the state and federal laws that impact the estate.
